Terms of Service - Formbreezy

1. Acceptance

By creating an account or using Formbreezy in any way, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

These terms are a contract between you and Formbreezy, a trading name of Sonny Taylor, United Kingdom.

2. What Formbreezy provides

Formbreezy is a multi-destination form processing service. You embed our API endpoint in any HTML form; we receive submissions, store them in your dashboard, and optionally forward them to one or more destinations you configure - including email, Slack, Discord, Telegram, Notion, Google Sheets, and custom webhooks. The service is designed for use on static websites where running your own backend is impractical.

3. Your account

You must provide a valid email address and keep it up to date.
You are responsible for keeping your account login credentials (email and password) confidential and for all activity that occurs under your account.
Each form endpoint is issued a form key (fb_key) that is embedded in your HTML and is intentionally public-facing. You are responsible for regenerating a form key if you wish to revoke access, and for ensuring your form keys are not used in a way that circumvents our usage limits.
You must be at least 18 years old to use Formbreezy.

4. Acceptable use

You agree not to use Formbreezy to:

Collect data from individuals without their knowledge or a lawful basis.
Transmit spam, phishing content, malware, or malicious payloads of any kind.
Harvest credentials or conduct credential stuffing, scraping, or data mining.
Process data that you do not have the right to collect, including special-category data under GDPR Article 9 (such as health, biometric, or political data) without explicit consent and prior written agreement with us.
Upload, store, or distribute content that is illegal or content that infringes third-party intellectual property rights.
Circumvent rate limits, abuse automated tooling, or attempt to overload or disrupt our infrastructure.
Violate any applicable law or regulation.

We reserve the right to suspend or terminate accounts that breach these rules without notice where necessary to protect the service or other users.

5. Billing and credits

Formbreezy operates a hybrid pricing model. Certain features are available under a monthly subscription plan; email delivery and other volume-based features are charged via a pre-purchased credit system. Current pricing and plan details are set out on our pricing page.

Credits are non-refundable. Once purchased, credits cannot be refunded, exchanged for cash, or transferred to another account.
Credits have no expiry date unless otherwise stated at the time of purchase.
Subscription fees are billed in advance on a monthly basis. We will give at least 30 days' notice of any price changes before they take effect for existing subscribers.
If a payment fails, we will attempt to notify you and may restrict access to paid features until payment is resolved. We will not delete your data solely due to a failed payment without reasonable notice.

6. Usage limits

Formbreezy applies rate limits and submission caps to ensure fair use and protect service stability for all users. Specific limits are detailed on our pricing page and may vary by plan.

We reserve the right to throttle, queue, or reject requests that exceed your plan limits or that we reasonably determine constitute abusive usage, even if that usage does not otherwise breach section 4. We will endeavour to notify you before taking action where practicable.

7. Data processing

When end-users submit your forms, Formbreezy processes that data on your behalf. You are the Data Controller for those submissions; we are the Data Processor. You are responsible for ensuring you have a lawful basis to collect the data your forms request and for maintaining an appropriate privacy policy on your own website.

Customers subject to GDPR or equivalent regulation may request a Data Processing Agreement (DPA) by emailing [email protected].

8. Third-party services

Formbreezy integrates with third-party services (including Discord, Slack, Telegram, Google Sheets, Notion, and Amazon SES) to deliver submissions to your chosen destinations. These services are independent of Formbreezy and governed by their own terms and privacy policies.

We are not liable for:

Outages, errors, or changes made by third-party providers that affect delivery.
Data handling by third-party services after a submission has been forwarded to them.
The discontinuation or modification of third-party APIs that may affect an integration.

We will endeavour to notify you of integration changes where we are able, but cannot guarantee continuity of any specific third-party integration.

9. Service availability

We aim to keep Formbreezy available at all times but make no guarantees of uptime. We may perform maintenance, apply updates, or suspend the service temporarily. We will provide reasonable notice for planned downtime where possible.

We do not guarantee delivery of any specific submission. Email delivery, webhook calls, and integration forwarding may fail due to network conditions, third-party outages, or configuration errors. You should not rely on Formbreezy as the sole record of submissions for critical business processes.

10. Beta features

Formbreezy may make beta or experimental features available. These are provided without warranty and may be changed, restricted, or removed at any time without notice. Do not rely on beta features for production-critical workflows.

11. Intellectual property

Formbreezy and all associated software, designs, and trademarks are owned by us. Using the service does not grant you any rights to our intellectual property.

You retain full ownership of your data and any content submitted through your forms.

12. Termination

You may close your account at any time from your dashboard. On closure, your account data and stored submissions will be deleted within 30 days. Encrypted backups may retain data for a short additional window for disaster recovery purposes; this data is not accessed except in the event of a system failure.

We may suspend or terminate your account if you breach these terms, or if we discontinue the service. If we discontinue the service, we will provide at least 30 days' notice by email and allow you to export your data. We may retain certain data beyond the deletion window where required by law, for fraud prevention, or for the resolution of ongoing disputes.

13. Indemnity

You agree to indemnify and hold harmless Formbreezy, its operators, and its personnel from any claims, damages, losses, or costs (including legal fees) arising from:

Your breach of these terms.
Your violation of any applicable law or third-party rights.
Data protection or GDPR violations caused by your use of the service (including your failure to have a lawful basis for collecting form submission data).
Spam, phishing, or other abusive use of Formbreezy by you or through your API keys.
Claims made by end-users of your forms arising from your data collection practices.

14. Limitation of liability

To the maximum extent permitted by law, Formbreezy is provided "as is" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for:

Loss of data, revenue, profits, or business arising from use of the service.
Failure to deliver, delay in delivery, or corruption of form submissions.
Unauthorised access to your account caused by your failure to keep credentials secure.
Any indirect, incidental, consequential, or punitive losses.

Our total liability to you in any 12-month period shall not exceed the amount you paid us during that period (or £100, whichever is greater).

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including the UK Consumer Rights Act 2015 where applicable).

15. Force majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including cloud provider outages, internet or network failures, DDoS attacks, acts of God, government actions, or other events outside our control. We will resume performance as soon as reasonably practicable.

16. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

17. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability and entire agreement

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Formbreezy with respect to the service and supersede all prior agreements and understandings.
